BY ACCESSING OR USING THE WYNFUSCATE PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE OUR SERVICES.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "You", "Your") and wYnFuscate ("we", "us", "our", "Company", "Service Provider") governing your access to and use of the wYnFuscate platform, including all software, services, APIs, and related documentation (collectively, the "Service").

By creating an account, accessing our platform, or using any of our services, you represent and warrant that:

  • You are at least 18 years of age or the age of majority in your jurisdiction
  • You have the legal capacity to enter into binding contracts
  • You are not prohibited by law from accessing or using our services
  • All information provided during registration is accurate, current, and complete

2. Service Description

wYnFuscate provides code obfuscation services for Lua and Luau programming languages ("Obfuscation Services"). Our Service transforms source code through virtualization, encryption, and other proprietary techniques to protect intellectual property.

We explicitly reserve the right to:

  • Modify, suspend, or discontinue any aspect of the Service at any time without notice
  • Impose or modify usage limits, quotas, and rate limits
  • Update our obfuscation algorithms and security features
  • Change pricing, plans, or feature availability
  • Refuse service to anyone for any reason at our sole discretion

3. ANTI-CIRCUMVENTION AND INTELLECTUAL PROPERTY PROTECTION

3.1 Prohibited Reverse Engineering Activities

You expressly agree that you SHALL NOT, and shall not permit any third party to:

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of any output produced by our Service
  • Create, distribute, or use tools designed to deobfuscate, analyze, or defeat the protection mechanisms applied by our Service
  • Circumvent, bypass, or disable any security features, access controls, watermarks, or technological protection measures embedded in obfuscated code
  • Perform any form of automated analysis including but not limited to: static analysis, dynamic analysis, symbolic execution, control flow analysis, or pattern recognition on obfuscated outputs
  • Share, publish, or disclose any information, techniques, or methodologies that could assist others in circumventing our protection mechanisms
  • Use machine learning, artificial intelligence, or statistical methods to identify patterns or create deobfuscation tools
  • Remove, alter, or obscure any copyright notices, proprietary markings, or embedded watermarks

3.2 DMCA and Legal Protections

Our obfuscation technology constitutes a technological protection measure under:

  • Digital Millennium Copyright Act (DMCA) 17 U.S.C. § 1201 et seq.
  • EU Copyright Directive 2001/29/EC Article 6
  • WIPO Copyright Treaty (WCT) Article 11
  • Comparable international intellectual property laws

Circumvention of our technological protection measures is a violation of federal and international law and may result in civil and criminal penalties including statutory damages up to $2,500 per act of circumvention, plus attorney's fees.

3.3 Proprietary Rights

All intellectual property rights in the Service, including but not limited to our obfuscation algorithms, virtual machine designs, watermarking systems, and protection methodologies, are the exclusive property of wYnFuscate. These rights are protected by copyright, trade secret, patent, and other intellectual property laws.

3.4 Enforcement

We actively monitor for violations of these anti-circumvention provisions. Upon detection of prohibited activities, we will:

  • Immediately terminate your account without refund
  • Pursue all available legal remedies including injunctive relief
  • Seek statutory damages, actual damages, and disgorgement of profits
  • Report violations to appropriate law enforcement agencies
  • Cooperate with criminal investigations under the Computer Fraud and Abuse Act (CFAA)

4. Account Terms and Termination

4.1 Account Registration

You must provide accurate, complete, and current information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

4.2 Immediate Termination Rights

WE RESERVE THE ABSOLUTE RIGHT TO TERMINATE, SUSPEND, OR RESTRICT YOUR ACCOUNT IMMEDIATELY, WITHOUT PRIOR NOTICE, WITHOUT REFUND, AND FOR ANY REASON OR NO REASON AT OUR SOLE DISCRETION.

Grounds for immediate termination include, but are not limited to:

  • Violation of any provision of these Terms
  • Suspected fraudulent, abusive, or illegal activity
  • Attempts to reverse engineer or circumvent our protections
  • Use of the Service for malicious purposes
  • Chargebacks or payment disputes
  • Sharing account credentials
  • Excessive API usage or abuse
  • At our discretion if we determine termination is necessary

4.3 Effects of Termination

Upon termination:

  • Your access to the Service will be immediately revoked
  • All stored files may be deleted without recovery options
  • Refunds are governed by Section 6 (Cancellation and Refund Policy)
  • If terminated for cause (violation of these Terms), you must cease all use of any obfuscated outputs generated through the Service
  • If you voluntarily cancel or your subscription expires, you may continue to use obfuscated outputs previously generated while your account was in good standing
  • Sections 3, 5, 6, 7, 9, 10, 13, 14, and 16 survive termination

5. Payment and Subscription Terms

5.1 Payment Processing

All payments are processed securely by Stripe, our third-party payment processor. We do not store your credit card numbers, bank account details, or other sensitive payment credentials on our servers. All payment data is handled in accordance with PCI DSS standards. By making a purchase, you also agree to Stripe's Terms of Service. All prices are in United States Dollars (USD).

5.2 Subscription Plans

We offer recurring subscription plans (monthly and yearly) that provide access to premium features and higher usage quotas. By subscribing, you authorize us to charge your payment method on a recurring basis at the applicable rate until you cancel.

  • Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date
  • Upgrades: Plan upgrades take effect immediately. You will be charged a prorated amount for the remainder of your current billing period
  • Downgrades: Plan downgrades take effect at the end of your current billing period. You retain access to your current plan until then
  • Billing Period Changes: Switching from monthly to yearly billing is treated as an upgrade (immediate, prorated). Switching from yearly to monthly takes effect at the end of your current yearly period

5.3 Obfuscation Credits

We offer one-time credit pack purchases. Each credit entitles you to one obfuscation.

  • Credits never expire
  • Credits are non-refundable and non-transferable
  • Credits are consumed only after your monthly subscription quota is exhausted
  • If a job that consumed a credit fails, the credit is automatically returned to your balance

5.4 Failed Payments

If a recurring payment fails, your subscription will enter a grace period of up to 7 days during which we will attempt to charge your payment method again. If payment cannot be collected after the grace period, your subscription may be suspended and your account will revert to Free plan limits until payment is resolved.

5.5 Price Changes

We may change our pricing at any time. For existing subscribers, we will provide at least 30 days' notice before any price increase takes effect. The new price will apply at the start of your next billing period after the notice period. If you do not agree with the new pricing, you may cancel before it takes effect.

6. Cancellation and Refund Policy

6.1 Subscription Cancellation

You may cancel your subscription at any time from your dashboard settings or via the Stripe Customer Portal. Upon cancellation:

  • Your subscription remains active until the end of your current billing period
  • No prorated refunds are issued for the remaining days in your billing period
  • After the billing period ends, your account reverts to Free plan limits
  • Any unused obfuscation credits in your balance remain available

6.2 Refund Policy

Subscriptions: We generally do not issue refunds for subscription payments. Refund requests may be submitted to [email protected] and will be reviewed on a case-by-case basis at our sole discretion.

Credit Packs: Credit pack purchases are final and non-refundable.

6.3 Chargebacks

If you initiate a chargeback or payment dispute with your bank or credit card company instead of contacting us first, we reserve the right to immediately suspend or terminate your account. We encourage you to contact [email protected] to resolve any billing issues before initiating a chargeback.

7. User Content and Intellectual Property

7.1 Your Content

You retain all ownership and intellectual property rights to the source code you upload to our Service ("Your Content"). We do not claim any ownership over your uploaded code or the obfuscated output generated from it. The obfuscated output belongs to you.

7.2 Limited License Grant

By uploading code to our Service, you grant wYnFuscate a limited, non-exclusive, revocable license to process, transform, and temporarily store your files solely for the purpose of providing the obfuscation service. This license terminates when your files are deleted from our systems in accordance with our retention policy.

7.3 Your Responsibilities

You represent and warrant that you have all necessary rights, licenses, and permissions to upload and obfuscate the code you submit. You are solely responsible for ensuring your use of our Service does not infringe upon the intellectual property rights of any third party.

8. Acceptable Use Policy

You agree NOT to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Obfuscate malware, viruses, exploits, or malicious code
  • Infringe upon intellectual property rights of others
  • Engage in unauthorized access to computer systems (hacking)
  • Circumvent game anti-cheat systems or terms of service
  • Create tools for cheating, exploitation, or game manipulation
  • Upload content you do not own or have rights to obfuscate
  • Resell or redistribute our Service without authorization
  • Conduct automated testing or benchmarking without permission

We are not responsible for how you use obfuscated code. You bear full legal responsibility for your use of the Service and any outputs generated.

9. Disclaimers and Limitations of Liability

9.1 "AS IS" Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED ACCESS.

9.2 Nature of Obfuscation

Code obfuscation is designed to increase the difficulty of reverse engineering, but it is not a guarantee of absolute protection. No obfuscation technology can prevent all forms of analysis or reverse engineering by sufficiently determined adversaries. Our Service provides a meaningful layer of protection for your code, but you acknowledge that:

  • Obfuscated code may potentially be deobfuscated or reverse engineered
  • We make no warranties regarding the absolute effectiveness of our protection
  • Security is a spectrum, and obfuscation is one layer of a broader protection strategy
  • We are not liable for any losses, damages, or consequences resulting from the deobfuscation or reverse engineering of your code

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WYNFUSCATE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, OR USE
  • COST OF SUBSTITUTE SERVICES
  • BUSINESS INTERRUPTION
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR CONTENT
  • ANY LOSSES ARISING FROM THE DEOBFUSCATION OR REVERSE ENGINEERING OF OBFUSCATED OUTPUTS

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS LESS.

10. Indemnification

You agree to indemnify, defend, and hold harmless wYnFuscate and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any laws or third-party rights
  • Content you submit for obfuscation
  • Use of obfuscated outputs you generate
  • Claims that your use infringes third-party intellectual property

11. Data Retention and Privacy

File Retention: Obfuscated files are stored for 14 days from completion. After this period, files are permanently deleted. We are not responsible for data loss.

Watermarking: We may embed invisible watermarks in obfuscated outputs for tracking and anti-piracy purposes. Removal or alteration of watermarks is strictly prohibited.

12. DMCA Copyright Agent

If you believe that your copyrighted work has been used or distributed through our Service in a way that constitutes copyright infringement, please notify our designated DMCA agent:

  • Identification of the copyrighted work claimed to have been infringed

  • A statement that the information is accurate and you are authorized to act
  • Your physical or electronic signature

13. Dispute Resolution

13.1 Binding Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

You agree to WAIVE YOUR RIGHT TO A JURY TRIAL and to participate in class actions or class arbitrations.

13.2 Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to conflict of law principles.

Exclusive venue for any disputes shall be in the state or federal courts located in Atlanta, Georgia. Arbitration proceedings shall take place in Atlanta, Georgia, or via online arbitration.

13.3 Equitable Relief

Notwithstanding the arbitration provision, we may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of our intellectual property rights.

14. Force Majeure and Third-Party Dependencies

14.1 Force Majeure

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to: natural disasters, acts of government, pandemic, war, terrorism, power outages, internet or telecommunications failures, cyberattacks, or third-party service outages.

14.2 Third-Party Service Dependencies

Our Service relies on third-party infrastructure providers including Stripe (payment processing), Cloudflare (security and CDN), Vercel (hosting), and others. We are not liable for any service interruptions, data processing delays, or errors caused by the unavailability or malfunction of these third-party services. We will make reasonable efforts to restore service promptly when disruptions occur.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

Material changes (pricing, features, usage limits) will be communicated via email to registered users at least 30 days before they take effect.

16. Miscellaneous

Severability: If any provision is found unenforceable, the remaining provisions continue in full force.

No Waiver: Failure to enforce any right does not constitute a waiver of that right.

Assignment: You may not assign these Terms without our consent. We may assign freely.

Entire Agreement: These Terms constitute the entire agreement between you and wYnFuscate regarding the Service.
